These Terms of Service ("Terms") govern your use of the Notary Day service operated by Notary Day at notaryday.app. By creating an account or using the service, you agree to these Terms. If you do not agree to these Terms, you should not use the service.
Notary Day is a scheduling, route-planning, profitability, and record-keeping tool for mobile notaries and loan signing agents. Features may include job scheduling, profitability checks, route planning, invoicing, reporting, reminders, public booking pages, and related functionality. Features may change, be added, or be removed as the service develops.
You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account. You must provide accurate information and keep it reasonably current. You must notify us if you believe your account has been accessed without authorization. You may not share or transfer your account in a way that violates these Terms or applicable law.
You retain responsibility for the information, records, documents, and other content you enter into Notary Day. You represent that you have the right and appropriate authorization to collect, use, and store information about clients, signers, borrowers, or other individuals through the service. You must not use Notary Day to store information that is unlawful to collect or that is unnecessary for your intended use of the service.
You agree not to misuse the service, including by attempting to gain unauthorized access, interfering with the service or its data, introducing malicious code, reverse engineering or circumventing security controls, reselling the service without permission, using the service for unlawful purposes, or violating the rights of others.
Notary Day is a software tool and does not provide legal, notarial, tax, financial, or professional advice. You remain responsible for complying with the laws, regulations, and professional requirements that apply to you, including applicable notarial journal, identification, record-keeping, privacy, and document-handling requirements in your jurisdiction. Notary Day does not determine whether a particular notarial act or procedure is legally permitted.
The Free plan is provided at no charge. Pro plans are billed monthly or annually as selected at checkout and are processed by our payment provider. You may cancel a paid subscription at any time. Cancellation stops future renewal, and access to paid features generally continues until the end of the applicable paid billing period. Fees are non-refundable except where required by law or expressly stated otherwise.
Canceling a paid subscription does not delete your account or data. When you cancel a subscription, your account may move to the Free plan after the paid period ends and your data remains available subject to the limits of that plan. You may export your data or request account deletion at any time. When an account deletion request is made, the account is soft-deleted and retained for up to 90 days before permanent deletion. During this period, the account is not available for normal use and may be recoverable where supported by the service. After the 90-day period, the account and associated personal data are permanently deleted, subject to our Privacy Policy and information we are required or permitted to retain.
Notary Day may rely on third-party services for functions such as hosting, payments, email delivery, geocoding, routing, analytics, and AI or document processing. Your use of features that depend on third-party services may also be subject to the applicable third party's terms and policies. We are not responsible for the availability or independent practices of third-party services.
The Notary Day service, including its software, design, branding, and original content, is owned by or licensed to Notary Day and is protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, reproduce, reverse engineer, or create derivative works from the service.
The service is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that the service will always be available, uninterrupted, error-free, or suitable for every particular purpose. Information, calculations, estimates, routes, profitability figures, and other outputs provided by the service are tools to assist you and should be independently reviewed before being relied upon.
To the maximum extent permitted by law, Notary Day will not be liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from your use of or inability to use the service, including decisions made based on information or calculations provided by the service. Nothing in these Terms excludes liability that cannot legally be excluded or limited.
We may update, modify, suspend, or discontinue parts of the service from time to time. We may also update these Terms as the service develops or as legal requirements change. Material changes will be reflected here or communicated through the service where appropriate. Continued use of the service after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
We may suspend or terminate an account where we reasonably believe the account is being used in violation of these Terms, applicable law, or in a way that threatens the security or integrity of the service. Where appropriate, we will provide notice and an opportunity to address the issue. Termination does not eliminate obligations that by their nature should survive termination.
